Terms & Conditions – London Camera & Antique Auction Ltd
By accessing or using the services of London Camera & Antique Auction Ltd (“the Auctioneer”, “we”, “us”), including participation in online or in-person auctions, you agree to comply with these Terms & Conditions. These Terms apply to both buyers and sellers.
1. Legal Framework and Governing Law
1.1 These Terms and Conditions, including any disputes arising from their interpretation or subject matter, are governed by and construed in accordance with the law of England.
1.2 English courts have exclusive jurisdiction to settle any dispute or claim arising from these Terms.
1.3 The Auctioneer acts as an agent for the seller. Any contract for the sale of a lot is formed directly between the seller and the buyer.
2. Eligibility
2.1 Buyers and sellers must be 18 years or older to participate in auctions.
2.2 By registering, you confirm that all information provided is true, accurate, and complete.
3. Seller Terms and Consignment
3.1 Consignment Requirements
Sellers must provide the following information:
Full legal name and proof of identity (passport, driver’s license, or national ID).
Contact details and bank account for proceeds.
Detailed description of items for sale, including provenance, condition, authenticity, and any third-party claims.
Indication of whether items are sold as a private seller or trader.
Failure to provide accurate or sufficient information may result in refusal of consignment.
3.2 Warranties
Sellers warrant that they:
Own the items and have the legal right to sell them.
Items are free of encumbrances, claims, or third-party rights.
Have disclosed any known defects, restorations, or authenticity issues.
3.3 Reserve Prices
Sellers may set a reserve price representing the minimum hammer price.
Reserves must be reasonable; unreasonably high reserves may result in refusal of the lot.
Once set, reserves cannot be changed without consent.
3.4 Unsold and Withdrawn Items
Unsold items may be reoffered in future auctions.
Withdrawn items after cataloguing are subject to charges: commission, loss and damage insurance, and any applicable photography or storage fees.
3.5 Liability and Loss
The Auctioneer is not liable for loss or damage to items, except as specified in any insurance or loss and damage arrangements agreed with the seller.
Sellers are responsible for shipping items to the saleroom or providing items for auction.
4. Buyer Terms
4.1 Bidding and Contracts
By bidding, buyers agree to be bound by these Terms.
All bids are final and legally binding.
The highest bid at auction close constitutes the winning bid.
4.2 Buyer’s Premium
A buyer’s premium is payable in addition to the hammer price: [Insert %].
VAT is applied at the prevailing rate on both the hammer price and buyer’s premium where applicable.
4.3 Payment

4.5 Item Descriptions and Condition
We provide condition reports where possible.
Buyers must inspect items prior to purchase, either in person or via provided images/descriptions.
Items are sold “as seen,” except where authenticity or condition is specifically guaranteed.
4.6 Export and VAT Regulations
Buyers intending to export items are responsible for export licenses, duties, and VAT.
Certain items (e.g., antique or restricted materials) may be subject to legal export restrictions.
5. Commission Bidding and Phone Bidding
Commission and phone bids must be arranged in advance.
The Auctioneer executes commission bids to achieve the lowest possible winning bid within limits set by the buyer.
All electronic communication is at the bidder’s risk.
6. Prohibited Use
Users must not:
Use the platform for illegal purposes.
Post false, misleading, or offensive content.
Interfere with auctions, security systems, or website functionality.
7. Termination
We may suspend or terminate accounts without notice if these Terms are violated.
8. Changes to Terms
We may update these Terms at any time.
Updated Terms will be posted on this page with a revised effective date.
